Terms of Service (Public Offer)

1. General Provisions

1.1. This offer constitutes the official proposal of Husar Vadym Vitaliyovych, hereinafter referred to as the "Seller," to conclude a remote purchase and sale agreement for goods (hereinafter referred to as the "Agreement") via the online store, and places a Public Offer (proposal) on the Seller's official website https://www.saint-pearl.com (hereinafter referred to as the "Website").

1.2. The moment of full and unconditional acceptance by the Buyer of the Seller's offer (acceptance) to conclude an electronic purchase and sale agreement is considered to be the moment of full payment for the order under the terms of this Agreement, within the timeframe and at the prices specified on the Website.

2. Terms and Definitions

2.1. In this Agreement, the following terms shall have the meanings set forth below:

  • "Goods" — non-food consumer goods (clothing, footwear, accessories, etc.) offered for sale via the Website.

  • "Online Store" — a platform for the sale of goods via electronic transactions.

  • "Seller" — the entity offering goods on the Website.

  • "Buyer" — an individual who places an Order and accepts this Agreement.

  • "Recipient" — the Buyer or another person designated to receive the Goods.

  • "Order" — the Buyer’s request to purchase selected Goods via the Website.

  • "Website" — https://www.saint-pearl.com and all its pages.
     

2.2. All terms are used in the meanings specified above regardless of grammatical form.

3. Subject of the Agreement

3.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to accept and pay for them.

3.2. Ownership of the Goods passes to the Buyer upon delivery and full payment.

3.3. The Buyer must review this Agreement before placing an Order.

3.4. The Seller reserves the right to amend this Agreement without prior notice. Changes take effect upon publication on the Website.

4. Ordering and Conclusion of the Agreement

4.1. The Buyer independently selects Goods and places an Order via the Website.

4.2. When placing an Order, the Buyer provides:

  • full name

  • phone number

  • email

  • delivery address

  • selected payment and delivery method

4.3. This Agreement is considered concluded at the moment of successful payment of the Order via the Website https://www.saint-pearl.com.

5. Payment Terms

5.1. Payment is made using available payment systems indicated on the Website.

5.2. If payment is not completed, the Seller reserves the right to cancel the Order.

6. Delivery Terms

6.1. Delivery is carried out according to the conditions specified on the Website.

7. Rights and Obligations of the Parties

7.1. The Seller has the right to suspend service in case of violation of this Agreement.

7.2. The Buyer is obliged to pay for and receive the order on time.

7.3. The Buyer has the right to place Orders via the Website.

8. Liability of the Parties

8.1. The Parties are liable in accordance with applicable law.

8.2. The Seller is not responsible for delays caused by delivery services or force majeure circumstances.

9. Other Conditions

9.1. The Seller may update this Agreement at any time.

9.2. The Buyer agrees to the processing of personal data necessary to fulfill the Order.

10. Returns

10.1. Goods may be returned within 14 calendar days from the date of receipt.

10.2. Returns are accepted only if the Goods have not been used and retain their original condition, packaging, and all tags.

10.3. Refunds are made using the same payment method that was used for the original transaction.

Refunds are not made to the IBAN or bank account unless such method was used during the initial payment.

10.4. The refund processing time may take from 10 to 14 business days from the moment the returned Goods are received and approved by the Seller. The exact timing depends on the policies of the issuing bank or payment provider.

11. Term of the Agreement

11.1. This Agreement comes into force upon acceptance (payment).

11.2. The Agreement remains valid until the Parties fulfill their obligations.
